The court found that Parliament’s earlier decision to block the impeachment process was unconstitutional and invalid, meaning the matter must now go before an impeachment committee.
The key point is that the ruling does not mean the president has been impeached. Instead, it creates a legal pathway for Parliament to examine whether there is enough evidence to proceed with a formal impeachment inquiry. If Parliament later recommends removal, that would still require a two-thirds majority vote. In simple terms, the ConCourt has revived the process, not delivered the final outcome. The ruling is significant because it strengthens parliamentary accountability and forces the Phala Phala report to be dealt with through the proper constitutional channel.
