Part 2 | The Digital Lexicon: Emojis and Legal Implications

Artificial Intelligence is changing the way legal professionals research, communicate and practise law—but what happens when AI gets it wrong? And can an emoji carry legal meaning in a court of law?

In Episode 6 of Beyond the Code: AI and Law, University of Johannesburg Vice-Chancellor Prof Letlhokwa Mpedi is joined by Prof Michele van Eck from the School of Law at the University of the Witwatersrand, Johannesburg, for a thought-provoking two-part discussion exploring some of the most pressing legal questions arising from the digital age.

Part 1: Hallucinations in the High Court – The Rise of Fake Case Law

As generative AI tools become increasingly common in legal practice, concerns are growing over AI "hallucinations"—instances where AI systems fabricate legal authorities, judgments or citations that do not exist. Prof Mpedi and Prof van Eck discuss the risks these errors pose to legal practitioners, the courts and the administration of justice, while considering how the legal profession can responsibly embrace AI.

Part 2: The Digital Lexicon – Emojis and Legal Implications

Communication has evolved beyond words. Emojis now form part of everyday conversations—but how are they interpreted in legal disputes? The discussion explores how courts assess the meaning, intent and evidential value of emojis in contracts, criminal matters, workplace disputes and digital communications.
