Has the Constitution failed us?

As we know, the ANC has just come out of an important national policy conference, where issues of the economy and social equality were emotive topics.

Land was one of the most contentious issues discussed at the policy conference. On the issue of land, Zuma said expropriation without compensation within the law may be considered to achieve the goal of redistribution. Zuma alluded to changes to the Constitution that could be effected through democratic processes.

The country’s socio-economic challenges are glaring.

Why has the country not made the kinds of social and economic advances that were promised in the negotiated settlement and incorporated in the 1996 Constitution?

To discuss this further, Professor Penelope Andrews, Dean of the Faculty of Law at UCT. Professor Andrews has published four books and more than 50 articles focusing on international human rights law, comparative constitutional law, and the judiciary.
